Terms of Service

1. Agreement to These Terms

By creating an ORBII account or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms form a binding agreement between you and ORBII.

2. ORBII Is Not an Emergency Service

ORBII is a safety-assistance tool. It raises alerts to the contacts and family circle you choose and, where applicable, to nearby users. It does not itself dispatch police, medical, or fire services, and it cannot guarantee that any person will see an alert, respond, or arrive.

In a genuine emergency you must always contact official emergency services on 112. You acknowledge and accept that ORBII is a supplement to, and never a substitute for, professional emergency response.

3. Eligibility

You must be at least 18 years old and able to form a legally binding contract to create an account and use safety-critical features such as SOS. You agree to provide accurate information, including a valid phone number and correct emergency contacts, so that help can reach you.

4. Your Account

You are responsible for keeping your device and account secure, including any safety PIN you set within the app. You agree to notify us promptly if you believe your account has been accessed or used without your permission. You are responsible for activity that occurs under your account.

5. Responsible Use of SOS

The SOS and alert features are intended for genuine safety situations only. You agree not to raise deliberately false alarms. Misusing these features wastes the time and goodwill of people trying to help and may result in suspension or termination of your account.

6. The Responder Network

ORBII may alert nearby users and, for Premium members, dispatch verified ORBII Responders. Responders are asked to provide presence and to help summon official assistance, not to physically confront anyone.

Responders act voluntarily and are not employees or agents of ORBII. While we verify the identity of Premium responders, ORBII does not control and is not responsible for the conduct, availability, or actions of any responder or other user.

7. Subscriptions & Billing

ORBII's core safety features are free. Optional paid plans (ORBII Plus and ORBII Family) are billed monthly through our third-party payment provider.

• Subscriptions renew automatically each billing period until cancelled.
• You can cancel at any time; cancellation stops future billing but does not refund the current period unless required by law.
• Prices are shown in the app and may change, with notice, for future billing periods.

8. Prohibited Conduct

You agree not to:

• Use ORBII to harass, stalk, monitor, or track any person without their informed consent
• Attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service
• Impersonate any person or misrepresent your identity, including in a responder application
• Use the Service for any unlawful purpose or in violation of these Terms

9. Intellectual Property

The ORBII name, logo, app, and all related content are owned by ORBII Safety and protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the app for its intended personal-safety purpose. You may not copy, modify, distribute, or create derivative works from the Service without our permission.

10. Disclaimers & Limitation of Liability

The Service is provided on an "as is" and "as available" basis. Mobile networks, GPS, device settings, operating systems, and third parties can fail in ways outside our control, and we cannot guarantee that any alert will always be delivered, received, or acted upon.

To the fullest extent permitted by law, ORBII and its operators will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of, or inability to use, the Service. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

11. Termination

You may stop using ORBII and delete your account at any time from Profile → Settings. We may suspend or terminate access for any user who breaches these Terms or misuses the safety features. On termination, your right to use the Service ends immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of India.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or via email before they take effect. The "Last updated" date above reflects the most recent revision, and your continued use of ORBII after that date constitutes acceptance of the updated Terms.
